2. The catalogue
The catalogue on the website is informational in nature and presents our furniture and interior pieces. Its content does not constitute a binding offer in the legal sense.
The availability, specifications, materials and colours of individual items may change. We reserve the right to amend the catalogue without prior notice.
3. Inquiries and orders
Inquiries and orders are submitted through the contact form or by email. Upon receiving an inquiry, we prepare a quote describing the items, prices and delivery time.
A contract between you and us is formed only upon our written order confirmation. No delivery obligations arise until the order is confirmed.
4. Prices
All prices are stated in euros (EUR). The prices stated in the written order confirmation are the ones that apply.
Any delivery and assembly costs are shown separately and agreed before the order is confirmed.
5. Custom-made items and lead times
Part of our offering consists of items made to measure or customised to your wishes. For such items, the production and delivery time are determined upon order confirmation.
Lead times are indicative and may vary due to the nature of handcrafted production or the availability of materials; we will inform you of any changes in good time.
6. Right of withdrawal
For distance contracts, a consumer has the right to withdraw from the contract within 14 days of receiving standard goods, without stating a reason, in accordance with the Slovenian Consumer Protection Act (ZVPot).
The right of withdrawal does not apply to items made to measure or customised to the consumer's personal requirements, as these are goods produced according to the buyer's precise instructions.
7. Complaints and warranty
We are liable for material defects in the goods in accordance with statutory provisions. You may assert a material defect if you notify us of it within the statutory period.
Report a complaint by email to barbara@modernist-studio.com with a description of the defect and accompanying photographs. We will work together to find an appropriate solution in accordance with applicable law.
8. Limitation of liability
To the extent permitted by applicable law, we are not liable for any indirect or consequential damage arising from the use of, or inability to use, the website.
Nothing in these terms excludes or limits our liability in cases where the law does not permit such exclusion or limitation.
9. Governing law and jurisdiction
These relationships are governed by the law of the Republic of Slovenia. Any disputes shall be resolved by the competent court in the Republic of Slovenia.
Consumers may also use the available out-of-court mechanisms for resolving consumer disputes in accordance with applicable law.
